1) What is the DMCA Policy?

The DMCA Policy of SendFerry explains how we handle copyright infringement claims under the Digital Millennium Copyright Act. SendFerry respects intellectual property rights and is committed to protecting the rights of copyright owners. As a file-hosting service provider, SendFerry operates under the safe harbor provisions of applicable copyright laws and does not actively monitor user-uploaded content. We respond promptly to properly submitted copyright complaints and may remove or disable access to allegedly infringing material when required.

2) How can a copyright owner submit a complaint?

If you believe that content hosted on SendFerry infringes your copyright, you must submit a written takedown notice that includes identification of the copyrighted work claimed to have been infringed, identification of the infringing material with its exact URL or direct link, your full legal name and contact information including email and address, a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner or the law, and a statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner. Incomplete or invalid notices may not be processed.

3) What happens after a notice is received?

Upon receiving a valid DMCA notice, SendFerry may remove or disable access to the allegedly infringing material without prior notice to the uploader. We may notify the user who uploaded the content about the complaint. SendFerry reserves the right to terminate the accounts of users who are determined to be repeat infringers. We also reserve the right to refuse service to users who repeatedly violate intellectual property rights.

4) Can a user submit a counter-notification?

If you believe that material was removed or disabled by mistake or misidentification, you may submit a counter-notification. The counter-notice must include your name and contact information, identification of the material that was removed and its prior location, a statement under penalty of perjury that you believe the removal was an error, and your consent to the jurisdiction of the appropriate legal authority. Upon receipt of a valid counter-notification, SendFerry may restore the material unless the original complainant files a court action within the legally required timeframe.

5) What are the responsibilities and limitations?

SendFerry acts solely as a neutral service provider and does not claim ownership of user-uploaded content. Users are solely responsible for ensuring that the material they upload does not infringe upon the rights of others. Any person who knowingly submits a false or misleading copyright claim may be liable for damages under applicable law. SendFerry reserves the right to modify this DMCA Policy at any time without prior notice, and continued use of the service constitutes acceptance of the updated policy.
